Limited Warranty

Alpha Technologies warrants that all instruments manufactured by Alpha Technologies will be free from defects in material and workmanship and will conform substantially to Alpha Technologies’ specifications as set forth in any applicable instrument documentation for a period of eighteen (18) months from the date of shipment or (12) months from date of installation, whichever period first ends.  Notice of any defect, including a reasonably detailed description of the problem or difficulty experienced, must be made to Alpha Technologies in writing within thirty (30) calendar days following discovery thereof and prior to the expiration of the warranty period as described above. Alpha Technologies shall, at its option, promptly repair or replace that portion of the equipment found by Alpha Technologies to be defective during the term of this   warranty, exclusive of freight charges; provided, however, that this warranty shall be void if Alpha Technologies' examination discloses that any defect may have been caused by misuse, abuse, neglect, accident, alteration, failure of electrical power, unauthorized repair or adjustment. Failure by Buyer to give such written notice within the applicable time period specified above shall be deemed an absolute and unconditional waiver of Buyer's claim for such defects. Defective instruments returned to Alpha Technologies’ plant or a designated Alpha Technologies location will be repaired or replaced at Alpha Technologies’ discretion.  Instruments returned to Alpha Technologies for which Alpha Technologies provides replacement instruments hereunder shall become the property of Alpha Technologies. At Alpha Technologies’ option, replacement of any instrument may be made by substitution of another instrument that is substantially similar in form and function. The warranty on repaired or replacement instruments furnished pursuant to this warranty shall be limited to the unexpired portion of the original warranty period.
